Seller agreement, buyer terms & mall policies
Plain language where it can be, careful language where it has to be. Opening a booth or placing an order means you agree to what is on this page.
1. What this mall is
Treasure Row is an online marketplace. We run the website, take the payment, and pass the money to the dealer. We are not the seller of anything listed in a booth, we never take possession of it, and we do not inspect it. Every item is sold by the independent dealer whose booth it sits in, and your contract for that item is with them. We are not an auction house, an appraiser, or an authenticator.
2. What you can sell
The door is wide. Antiques and vintage goods. Collectibles, ephemera, and paper. Salvage, architectural pieces, and old tools. Used household goods, clothing, books, records, and furniture. Upcycled and repaired pieces. Craft and art supplies. And things you made yourself, including pottery, woodwork, leather, sewing, jewellery, art, and 3D-printed or laser-cut goods.
New merchandise is fine when it is genuinely yours: made by you, or small-batch goods you produce. What we do not want is a booth that is really a dropship catalogue of mass-produced items anyone can order wholesale.
3. What you cannot sell
Counterfeit, replica, or unlicensed branded merchandise of any kind, and anything infringing someone else’s trademark, copyright, or design rights. Recalled or banned products. Weapons, ammunition, explosives, and weapon parts. Drugs, paraphernalia, tobacco, vapes, and alcohol. Hazardous materials. Human remains, ivory, and anything covered by endangered-species rules. Stolen property. Personal data, account credentials, and digital goods you did not create. Food, cosmetics, and supplements. Anything a payment processor prohibits, and anything illegal under federal law or the law of Missouri.
On counterfeits specifically. Listing a counterfeit or unlicensed branded item is grounds for immediate removal of the listing, forfeiture of the sale, and closure of the booth. The mall does not authenticate goods and makes no representation that any item is genuine, correctly attributed, or correctly dated. Responsibility for the authenticity and legality of an item rests entirely with the dealer who listed it.
4. Handmade and 3D-printed goods
If you sell 3D-printed, laser-cut, CNC-carved, or otherwise digitally fabricated items, you must own the design or hold a licence that permits commercial sale of prints from it. Plenty of free and paid model files are licensed for personal use only, and printing one to sell is a copyright violation no matter who pressed go on the printer. Same for fan art, character models, team logos, and anything carrying someone else’s brand. You hold the rights; the mall does not verify licences and is not a party to them.
5. Booth standards
Photograph the actual item, not a stock photo. Describe the condition honestly, flaws included, and give measurements. Do not claim an age, maker, or material you cannot support. Ship within the window your booth policy promises, with tracking, or have local pickups ready within the window your pickup note promises. Answer messages and offers within two business days. A booth opens to shoppers once it has 10 items on the shelf, and the first 5 items in your application are reviewed by a person before you are approved. Keep it there: a booth that drops below 10 items gets a reminder, and one that is still short after 15 days is taken off the shop front until it is restocked. Nothing is deleted, and the booth reopens as soon as it is back to 10.
6. Fees and payouts
Opening a booth is free. No monthly rent, no listing fee. The mall takes a 15% commission on the item price of each sale — never on shipping — after a welcome perk in which a new booth’s first 3 item sales carry no commission at all. Card processing (currently 2.9% + $0.30 per charge) is passed through at cost. Shipping the buyer paid goes to the booth in full. Commission is calculated on what the buyer actually pays, so a discount or an accepted offer lowers it too.
Payouts run every Friday to the bank account you connect through Stripe, for orders you have marked shipped or picked up. Stripe verifies your identity and holds your banking details; the mall never sees them. Commission rates can change with 30 days’ notice, and a change never applies to an order already placed.
7. Damage, loss and reimbursement
The mall is not responsible for items that arrive damaged, broken, lost, or not as described. We never handle the goods. Packing, insuring, and shipping an item is the dealer’s job, and the risk of damage in transit sits with the dealer, not with Treasure Row.
That said, a buyer who receives a broken item should not have to fight about it. So the mall will refund the buyer directly when an item arrives damaged or materially not as described, and then recover that amount from the dealer. By opening a booth you authorise the mall to deduct the refunded amount, plus any related shipping or processing cost, from your current or future payouts, or to charge the payment method on file if your payouts do not cover it. If a balance stays unsettled the booth is suspended until it does. We will tell you before we act and give you a chance to show the claim is wrong.
8. Returns
Each booth sets its own return policy, shown on its booth page, and that policy governs buyer’s-remorse returns. Regardless of it, the mall guarantees a refund for items that arrive damaged, never arrive, or are materially not as described. Open a claim within 7 days of delivery and keep the packaging. Items sold as-is, and pieces the listing plainly describes as damaged or for parts, are not covered by that guarantee for the flaws that were disclosed.
9. Buyer protection
Message the booth first — most dealers make it right the same day. If it is not resolved within 3 days, contact the mall and we will step in. Refunds go back to the original card. An offer is not binding until the dealer accepts it and you complete checkout; an accepted offer is held for 48 hours and does not reserve the item against another buyer paying the asking price in the meantime.
10. Limitation of liability and disclaimers
The site and everything listed on it is provided “as is” and “as available”, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, title, authenticity, and non-infringement, to the fullest extent the law allows. We do not warrant that the site will be uninterrupted, error-free, or secure.
To the fullest extent permitted by law, Treasure Row is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost sales, lost data, or loss of goodwill, arising out of the site, a transaction, or an item — whether the claim sounds in contract, tort, or anything else, and whether or not we were told such damages were possible. Our total liability for any claim relating to a transaction is capped at the amount the buyer paid for the item in question, and for any other claim at $100.
Dealers agree to indemnify and hold Treasure Row harmless from claims, damages, and costs (including reasonable legal fees) arising from items they list or sell, from their descriptions of those items, from intellectual-property claims, and from any failure to meet these rules. Buyers and dealers deal with each other at their own risk. These terms are governed by the laws of the State of Missouri, and any dispute is brought in the state or federal courts serving Pettis County, Missouri. Nothing here limits liability that cannot be limited by law.
11. Taxes
As a marketplace facilitator the mall calculates, collects and remits state and local sales tax on orders shipped to or picked up in states that require it, Missouri included, so dealers do not have to. Sales tax is not commissionable and is not part of your payout. You are responsible for your own income taxes. Stripe issues a 1099-K to dealers who pass the reporting thresholds. The mall does not give tax advice.
12. Privacy
We collect what we need to run the mall: your name, email, shipping address, and a phone number if you choose pickup; the orders, offers and messages you send; and basic technical data about your visit. Payment card details go straight to Stripe and never touch our servers. We share a buyer’s name and shipping address with the dealer whose booth they bought from, only so that order can be shipped — dealers may not use it for anything else, marketing included. We do not sell personal information. You can ask us to delete your account and personal data at any time, except records we have to keep for tax and accounting.
13. Suspension and closing a booth
You can close your booth at any time from settings — there is no contract, because there is no rent. Open orders must still be shipped, and any unsettled claim balance is still owed. We can suspend or close a booth that breaks these rules, that has an unresolved damage claim, that goes quiet while orders sit unshipped, or that puts the mall or its payment processor at risk.
14. Changes and contact
We post changes here and email dealers about anything affecting fees, payouts, or liability at least 30 days before it takes effect. Continuing to use the mall after that means you accept the change.
